1. Introduction

This Acceptable Use Policy ("AUP") sets out the rules and guidelines that govern the use of the Aplas platform and related services provided by Aplas Pty Ltd (ABN 17 625 144 461) ("Company", "we", "us", "our").

This AUP forms part of the Terms of Service and applies to all Users of Aplas.

By accessing or using Aplas, you agree to comply with this AUP. If you do not agree to this AUP, you must not use Aplas.

2. Permitted Use

Users may use Aplas only for lawful purposes and in accordance with the Terms of Service, applicable Commercial Terms, and this AUP. Users must use Aplas in a manner consistent with its intended purpose as a software mapping and data visualisation platform.

3. Prohibited Conduct

Users must not:

  1. use Aplas for any purpose that is unlawful, fraudulent, or harmful;

  2. upload, transmit, or store any content that infringes the intellectual property rights of any third party;

  3. upload, transmit, or store any content that is defamatory, obscene, threatening, abusive, or otherwise objectionable;

  4. attempt to gain unauthorised access to Aplas, other user accounts, or any related systems or networks;

  5. introduce any virus, worm, trojan, ransomware, or other malicious code into Aplas;

  6. interfere with or disrupt the integrity, security, or performance of Aplas or its underlying infrastructure;

  7. use Aplas to send unsolicited communications, spam, or bulk messages;

  8. use Aplas for competitive analysis, benchmarking, or to build a competing product, unless expressly permitted in the Commercial Terms;

  9. scrape, crawl, or use automated means to access Aplas other than through the Company's published APIs;

  10. sublicence, resell, or distribute access to Aplas to any third party without the Company's prior written consent;

  11. circumvent or attempt to circumvent any security measures, access controls, or usage limits implemented by the Company;

  12. use Aplas in any way that could damage, disable, overburden, or impair the platform or interfere with any other party's use of Aplas; or

  13. attempt to access data belonging to another organisation or tenant within Aplas.

4. Data and Content Standards

Users are responsible for ensuring that all data and content uploaded to or created within Aplas:

  1. complies with all applicable laws and regulations;

  2. does not contain any personal data unless the User has a lawful basis for processing that data and has complied with all applicable Data Protection Laws; and

  3. is accurate, complete, and not misleading.

5. API Usage

The Company provides published APIs to enable programmatic access to Aplas. Users of the API must:

  1. comply with all published rate limits, quotas, and usage restrictions, and not make API requests at a volume or frequency that degrades the performance or availability of Aplas for other users;

  2. maintain the confidentiality and security of all API keys, tokens, and credentials, and not embed them in client-side code, public repositories, or any other publicly accessible location;

  3. rotate API keys and tokens periodically and revoke any credentials that may have been compromised;

  4. not use the API to systematically download, replicate, or redistribute data from Aplas for the purpose of building a competing product or service;

  5. ensure that any third-party systems, integrations, or webhooks connected to Aplas via the API are secured and maintained in accordance with industry-standard security practices; and

  6. accept responsibility for all activity that occurs through their API credentials, including activity by third-party integrations authorised by the User.

6. Security

Users must:

  1. maintain the confidentiality and security of their account credentials, including passwords and API keys;

  2. notify the Company immediately upon becoming aware of any unauthorised access to or use of their account or API credentials;

  3. not share account credentials with any unauthorised person; and

  4. implement and maintain reasonable security measures appropriate to the sensitivity of the data stored in Aplas.

7. Enforcement

The Company reserves the right to investigate any suspected violation of this AUP and to take appropriate action, which may include:

  1. issuing a warning;

  2. temporarily suspending the User's access to Aplas;

  3. permanently terminating the User's account; or

  4. reporting the conduct to the relevant law enforcement authorities.

The Company will use reasonable efforts to provide notice before taking enforcement action, except where immediate action is necessary to protect the security or integrity of Aplas, other users, or to comply with applicable law.

9. Monitoring

The Company may monitor use of Aplas, including API usage, to ensure compliance with this AUP, to maintain the security and performance of the platform, and to comply with applicable law. The Company will handle any data collected through monitoring in accordance with its Privacy Policy.

10. Changes to This Policy

The Company may update this AUP from time to time. Material changes will be notified in accordance with the Terms of Service.
